In certain circumstances outlined below, the NHBRC will carry out rectification of major structural defects.

When will the NHBRC pay for rectification?

A housing consumer has a right to rectification to be paid for by the NHBRC fund if major structural defect occurs within five years of the date of occupation and the

  • Housing consumer notifies the home builder within that period;
  • Defect is a result of non-compliance with the NHBRC's technical requirements;
  • Home builder is in breach of his or her obligations to rectify a major structural defect;
  • Home was built by registered builder who was registered with the fund on the date of occupation; and
  • Provincial housing department has made the application for rectification in the case of a subsidy-only home.

What the NHBRC Covers

The NHBRC fund for rectification covers 'a home', which includes the following:.

  • The private drainage system for the structure up to the municipal connection or the access pit connection;
  • Any garage or storeroom;
  • Any permanent outbuilding designed for residential purposes or for a purpose ancillary to residential purposes, and
  • Any retaining wall that will affect the structural integrity of the house.
